1. Introduction
Bynarize ("Bynarize", "we", "us" or "our") provides the Bynarize HRMS platform and this marketing website at bynarize.com. We respect your privacy and are committed to protecting your personal data in line with the Digital Personal Data Protection Act, 2023 (DPDP Act) and other applicable laws.
This Privacy Policy explains what personal data we collect, how we use it, who we share it with, and the rights available to you. It covers visitors to this website and prospects who interact with our sales, demo and free-tool experiences.
2. Our role: Data Fiduciary and Data Processor
For data we collect directly from website visitors and prospects (for example, demo requests and tool inputs), Bynarize acts as the Data Fiduciary.
When our customers use the Bynarize HRMS product to process data about their own employees, visitors and assets, the customer is the Data Fiduciary and Bynarize acts as a Data Processor on their behalf, strictly under the instructions set out in our customer agreement and Data Processing Addendum.
3. Information we collect
We collect the following categories of personal data:
- Contact details you provide — name, work email, phone number, company name, team size and role, when you book a demo, contact sales or download a resource.
- Tool inputs — figures you enter into interactive calculators (such as headcount, salary ranges or audit answers). Where a tool runs entirely in your browser, those inputs are not transmitted to our servers.
- Usage data — pages visited, referring source, approximate location derived from IP, device and browser type, collected through analytics and cookies.
- Communications — the content of emails, WhatsApp messages, support requests and demo conversations you have with us.
4. How we use your data
We use personal data only for clear, lawful purposes, including to:
- Respond to demo requests, sales enquiries and support questions.
- Provide the free tools and personalised results you ask for.
- Improve the website, our products and the relevance of what we show you.
- Send service and (where you have consented) marketing communications, which you can opt out of at any time.
- Meet legal, accounting and security obligations and prevent fraud or abuse.
5. Lawful basis and consent
We process your data on the basis of your consent, to take steps at your request before entering into a contract, to perform a contract with you, and for our legitimate interests in running and improving our business. Where consent is the basis, you may withdraw it at any time without affecting processing already carried out.
6. How we share data
We do not sell your personal data. We share it only with:
- Trusted service providers (such as hosting, analytics, email and CRM providers) who process data on our behalf under appropriate contracts.
- Professional advisers, auditors or authorities where required by law or to protect our legal rights.
- A successor entity in the event of a merger, acquisition or reorganisation, subject to this Policy.
7. Data retention
We keep personal data only for as long as necessary for the purposes described above, to comply with legal obligations, resolve disputes and enforce our agreements. Prospect data that does not convert is reviewed and deleted or anonymised on a periodic basis.
8. How we protect your data
We apply technical and organisational measures appropriate to the risk, including encryption in transit, role-based access controls, least-privilege access and audit logging. No method of transmission or storage is completely secure, but we work continuously to safeguard your data.
9. Your rights
Subject to applicable law, you have the right to:
- Access the personal data we hold about you and request a copy.
- Request correction of inaccurate or incomplete data.
- Request erasure of your data where it is no longer needed.
- Withdraw consent and opt out of marketing communications.
- Nominate another person to exercise your rights in the event of death or incapacity, as provided under the DPDP Act.
10. Children’s data
This website is intended for business users and is not directed at children. We do not knowingly collect personal data from children. If you believe a child has provided us data, please contact us so we can remove it.
11. Changes to this Policy
We may update this Privacy Policy from time to time. The "Last updated" date at the top reflects the latest version. Material changes will be highlighted on this page.
